We therefore ask you to keep your credentials confidential and to inform Tiarè di Baiardini Clorinda immediately if you suspect that there has been unauthorized access to your account or that your password has been violated. Duration and termination

Registration for the Services will be effective from the moment you receive the relevant confirmation email and for the entire period in which you use the Services. You may cancel your subscription to the Services at any time and for any reason by sending an email to the following address: salerno.tiare@gmail.com. In the event that you have exercised the right of withdrawal, we will send you an email to confirm that you have been cancelled from the Services. Tiarè di Baiardini Clorinda reserves the right to cancel your registration to the Services in the event of a violation of the provisions contained in these Conditions, or in the event that complete, truthful and correct personal data have not been provided, without prejudice to the right to compensation for damages suffered. Tiarè di Baiardini Clorinda also reserves the right to temporarily suspend, without prior notice, the provision of the Services for the time necessary for the technical interventions necessary and/or appropriate to improve the quality of the Services. Tiarè di Baiardini Clorinda may, at any time, interrupt the provision of the Services if there are security reasons.

Service warnings

Tiarè di Baiardini Clorinda makes every effort to provide accurate Services. Subject to the limitations of the law, the Services are provided free of charge as they are (“AS IS”). Tiarè di Baiardini Clorinda does not provide any guarantee, by way of example and not limited to, regarding the quality, good functioning, absence of interruptions or suitability of the Services for a particular purpose or result set by the user.

GENERAL CONDITIONS OF SALE

The sale of products on our website (“tiareluxury.it”) is governed by these General Conditions of Sale.

The products purchased on tiareluxury.it are sold directly by Tiarè di Baiardini Clorinda, a sole proprietorship, with registered office in Italy, Via Lorenzo Fava , 26 – 84014 Nocera Inferiore SA (Italy) , registered in the Company Register, Tax Code and VAT no. 05508020657.

Trade policy

The Seller carries out its e-commerce activity on tiareluxury.it exclusively towards its end users who have reached the age of majority and who are “consumers”.
When we talk about “consumer” we mean any natural person who acts on tiareprofumeria.it for purposes not related to their commercial, entrepreneurial or professional activity, if any. If you are not a “consumer”, we invite you to refrain from concluding commercial transactions on tiareluxury.it.
In consideration of its commercial policy, the Seller reserves the right not to accept purchase order proposals from persons other than the "consumer" or in any case purchase order proposals that do not comply with its commercial policy, such as, for example, order proposals for which there is a report, or suspicion, of fraudulent or illegal activity. In such cases, the Seller will inform the user of the non-acceptance of the order proposal. All order proposals sent to the Seller and returns made by users must also correspond to normal consumption needs. The Seller therefore monitors the number of order proposals sent and returns made.
These General Conditions of Sale exclusively regulate the sending of purchase order proposals for products available on tiareprofumeria.it by the user and their acceptance by the Seller.
The General Conditions of Sale do not regulate the supply of services or the sale of products by parties other than the Seller that appear on tiareprofumeria.it via links, banners or other hypertext connections.
The prices and sales methods that occur on the tiareprofumeria.it website may be different from those that occur in the physical stores of Tiarè di Baiardini Clorinda.

Information aimed at concluding the contract with the Seller pursuant to Legislative Decree 9 April 2003, n. 70

To conclude the purchase contract for one or more products on tiareluxury.it, you must send a purchase order proposal electronically to the Seller by filling out the form available on tiarethebeauty.it and following the relevant instructions.
Before sending the order proposal, we remind you to carefully read the General Conditions of Sale and the information on the right of withdrawal, to print a copy using the print command and to save or reproduce a copy for your personal use. In accordance with Article 51, paragraph 7, of Legislative Decree 6 September 2005, n. 206 (the "Consumer Code"), before sending the order proposal, we will provide you with a summary of the commercial and contractual conditions that will apply to your order proposal for the purchase of the products and a summary of the information on the essential characteristics of each product ordered with the relative price (including all applicable taxes or duties), the means of payment that you can use to purchase each product, the delivery methods of the products purchased, the shipping and delivery costs; as well as the references, geographical address and contact methods of the Seller and the date by which the Seller, once your order proposal has been accepted, undertakes to deliver the goods. The Seller will also provide you with a summary of the conditions and methods for exercising your right of withdrawal. If applicable, you will be informed that, in the event of withdrawal, you will have to bear the cost of returning the products. In any case, you will be reminded of the existence of the legal guarantee of conformity of the products, you will be provided with the contact details of our after-sales service and we will remind you of the possibility of using the platform for the alternative extra-judicial resolution of disputes, accessible on the site http://ec.europa.eu/odr , made available by the European Commission.
On the order proposal confirmation page, which contains a link to the General Conditions of Sale and the Information on the Right of Withdrawal, we will provide you with summary information about the essential characteristics of each product indicated in your order proposal, the price (including all applicable taxes or duties) and shipping costs.
The transmission of the order proposal to the Seller constitutes a binding purchase proposal for the user. Before proceeding with the transmission of the order proposal, you will therefore be asked to identify and correct any errors in data entry.
Once you have submitted your order proposal, we will send you an automatic email to confirm receipt of your order proposal. Receipt of this email does not constitute acceptance of your order proposal.
The contract is concluded when your order proposal is accepted by the Seller. The Seller will send you a second email to confirm acceptance of your order proposal and shipment of the products. This email will also contain a copy of the General Conditions of Sale and the summary document on the Right of Withdrawal.
The order proposal sent to the Seller will be archived in our database for the period of time necessary to process the order proposals accepted by the Seller and in any case within the terms of the law. You can access your order proposal form by consulting the My Order section.
The language available for concluding the contract with the Seller is Italian.
The Seller may not accept your purchase order proposals that do not provide sufficient guarantees of solvency or that are incomplete or incorrect or in the event of unavailability of the products.
In these cases, the Seller will inform you by email that the contract has not been concluded and that the Seller has not accepted your purchase order proposal, specifying the reasons. If the products presented on tiareprofumeria.it are no longer available or on sale at the time of receipt or processing of your purchase order proposal, the Seller will inform you promptly and in any case within thirty (30) days from the day following the day on which you sent your order proposal to the Seller, of the possible unavailability of the products. If you have already paid the price for the products, the Seller will refund, without undue delay, the amount already paid by you and the sales contract will be considered terminated.
We remind you that, by electronically transmitting the order proposal, you unconditionally accept and undertake to observe the Seller's General Conditions of Sale. If you do not agree with some of the terms set out in the General Conditions of Sale, we invite you not to submit your order proposal for the purchase of products on tiareprofumeria.it.
By submitting the order proposal you confirm that you also know and accept the additional information contained in tiareluxury.it.

Product guarantees and price indications

Tiarè di Baiardini Clorinda sells exclusively luxury and premium brand products. These products are purchased directly by Tiarè di Baiardini Clorinda from official manufacturers and retailers.
Tiarè di Baiardini Clorinda does not sell used, irregular or lower quality products than the corresponding standards offered on the market.
The essential characteristics of the products are presented on tiareprofumeria.it within each product description. The images and colours of the products presented on tiareluxury.it may however not correspond to the real ones due to the Internet browser and monitor used.
Product prices may be subject to change. Please check the final sale price before submitting the relevant order proposal. In the event that a recognizable error is found in the indication - by the Seller - of the price of a product or in the calculation of the amount requested for payment, the Seller will not accept the order proposal and will contact the user in order to offer the opportunity to submit the purchase order proposal for the product(s) at the correct price.
Purchase requests from countries not included among those displayed on the splash page cannot be accepted by the Seller.
All products sold by Tiarè di Baiardini Clorinda are provided with a guarantee seal.
All products sold on tiareluxury.it are covered by the legal guarantee of twenty-four (24) months for defects of conformity, in accordance with the applicable law. The lack of conformity of the product must be communicated to the Seller within two (2) months of its discovery. The lack of conformity of the products sold by Tiarè di Baiardini Clorinda can be communicated to Tiarè di Baiardini Clorinda by contacting us by email. In the event of a lack of conformity, you have the right to request the repair or replacement of the product. In the event that the aforementioned remedies are not possible or are excessively onerous, you will be entitled to a reduction in the price paid or to the termination of the sales contract, pursuant to art. 130 of the Consumer Code.

Payments

To pay the price of the products and the related shipping and delivery costs, you can follow one of the methods indicated in the order proposal form. In no case will you be charged costs higher than those actually incurred by the Seller, in relation to the payment instrument chosen by you.

In case of payment by credit card, the financial information (for example, the credit/debit card number or its expiration date) will be forwarded, via encrypted protocol, to Banca Intesa Sanpaolo or other banks, which provide the related remote electronic payment services, without third parties being able to access them in any way. Furthermore, such information will never be used by the Seller except to complete the procedures relating to your purchase and to issue the relevant refunds in the event of any returns of the products, following the exercise of your right of withdrawal, or if it becomes necessary to prevent or report to the police the commission of fraud on tiareluxury.it. The price for the purchase of the products and the shipping costs, as indicated in the order proposal, will be charged to your current account at the time of shipment of the purchased products.

Voucher

Vouchers are personalized codes that allow you to take advantage of a discount on purchases made on Tiareluxury.it exclusively for products sold by Tiarè di Baiardini Clorinda.
The box for entering the code is displayed on the first page of the purchase process: once you have added the items to the Shopping Bag, enter your code in the box and click Recalculate. At this point the discount will be automatically applied to all products, except those to which the application of vouchers is not possible. Therefore, the other items added to the Shopping Bag will not be subject to any discount. The voucher can only be used once and cannot be converted into money in any way. It will not be possible to use multiple vouchers in the same order proposal.
In case you want to return an item to which you have applied the voucher, you will have to follow the return procedure indicated in the information on the right of withdrawal. Once your return has been accepted, you can request the reactivation of the code with its original value. The difference in expenditure that you incurred for the purchase of the item will be credited back to you according to the methods and terms provided for the normal refund procedure.

Shipping and delivery of products

Please pay attention to what is reported in this section because the information contained therein forms an integral and substantial part of these General Conditions of Sale and, therefore, are considered to be fully known and accepted by you at the time of transmission of the order proposal.

Right of withdrawal

Refund times and methods

Whatever the payment method used by you, the refund due, whether full or partial, is activated by the Seller, as quickly as possible and in any case within fourteen (14) days from the date on which the Seller became aware of the exercise of your right of withdrawal, after verifying the correct execution of your right of withdrawal and checking the returned products.
The Seller will refund using the same means of payment you used to purchase the returned products, unless you have expressly agreed with the Seller to use a different means of payment and provided that you do not incur any additional costs as a consequence of the refund. If there is no correspondence between the recipient of the products indicated in the order proposal and the person who made the payment of the sums due for their purchase, the refund of the sums, in the event of exercising the right of withdrawal, will be made by the Seller, in any case, to the person who made the payment.
We remind you that the value date of the re-credit is the same as the debit; consequently you will not suffer any loss in terms of bank interest.
If you purchase via Klarna, a 3% fee will be deducted from your refund.

Applicable law and dispute resolution

Without prejudice to the application of mandatory European consumer protection provisions, the General Conditions of Sale are governed by Italian law and in particular by the Consumer Code and Legislative Decree 9 April 2003, no. 70 (“Implementation of Directive 2000/31/EC on certain legal aspects of information society services in the internal market, with particular reference to electronic commerce”).
In the event of disputes between Tiarè di Baiardini Clorinda and each end user, arising from the General Conditions of Sale, we inform you that the European Commission provides a platform for the alternative extra-judicial resolution of disputes, accessible on the website http://ec.europa.eu/odr .
For all disputes relating to purchases and/or these General Conditions of Sale, the Court of the place of domicile or residence of the consumer shall have jurisdiction in accordance with the applicable law or, at the consumer's choice, the Court of Nocera Inferiore.

RIGHT OF WITHDRAWAL

Right of withdrawal from the contract signed with Tiarè di Baiardini Clorinda

In accordance with art. 52 of Legislative Decree 6 September 2005 n. 206 (the “Consumer Code”), you have the right to withdraw from the contract signed with Tiarè di Baiardini Clorinda without any penalty and without having to provide any reason, within 14 days from the day you received the products purchased on tiareprofumeria.it.
In accordance with art. 54 of the Consumer Code, you may exercise the right of withdrawal using, at your choice, one of the following methods:

Online transmission to Tiarè di Baiardini Clorinda of the Return Form found in the Customer Service area, filled out in full; in this case, Tiarè di Baiardini Clorinda will send you confirmation by e-mail of receipt of the withdrawal declaration;
Send by post to Tiarè di Baiardini Clorinda the return form that you find in the Customer Service area, compliant with the standard form pursuant to art. 49, paragraph 4, of the Consumer Code, to be filled out in full;
Sending by post to Tiarè di Baiardini Clorinda another explicit declaration of your decision to withdraw from the contract.
In cases 2) and 3) your declaration must be sent to the attention of Customer Service at the registered office of Tiarè di Baiardini Clorinda, located in Via Lorenzo Fava , 26 – 84014 Nocera Inferiore (Italy). It is understood that, in such cases, you will be responsible for proving the correct and timely exercise of the right of withdrawal.
In accordance with art. 57 of the Consumer Code, once you have exercised the right of withdrawal from the contract, the products to be returned must be delivered to the courier within fourteen (14) days from the date on which you communicated to Tiarè di Baiardini Clorinda your decision to withdraw from the contract.
In accordance with art. 59 of the Consumer Code, the right of withdrawal is excluded if you have purchased products made to measure or personalized or sealed goods that are not suitable for return for reasons of hygiene or related to health protection and have been opened after delivery.

Conditions for exercising the right of withdrawal in accordance with art. 52 of the Consumer Code

The right of withdrawal is considered to be correctly exercised if the following conditions are fully respected:

The right of withdrawal must be regularly exercised within fourteen (14) days of receipt of the products by following one of the methods indicated above;
The products must not have been used, worn, washed and, in any case, must comply with the requirements indicated in art. 3, which follows, on the conformity checks of the returned products;
The identification tag must still be attached to the products with the disposable seal which forms an integral part of the item (see in this regard the following art. 5);
Products must be returned in their original packaging (if you want to return a kit, you must return all the items that compose it);
Returned products must be delivered to the carrier within fourteen (14) days from when you communicated to Tiarè di Baiardini Clorinda your decision to withdraw from the contract;
The products must not be damaged.
If you have complied with all the required conditions, Tiarè di Baiardini Clorinda, in accordance with art. 56 of the Consumer Code, will fully refund you the price of the products purchased, with you only being responsible for the return costs, i.e. those for returning the purchased products to Tiarè di Baiardini Clorinda, unless Tiarè di Baiardini Clorinda has expressly exempted you from such costs at the time of purchase and on the further condition that you use the forwarder and shipping methods suggested by Tiarè di Baiardini Clorinda in the following paragraph.

How to return products to Tiarè di Baiardini Clorinda

You will be free to return the products with the courier that you deem most appropriate. The return costs will be entirely borne by the customer and so will the responsibility in case of loss or damage of the products during transport. The returned products must be delivered to our headquarters no later than 14 days from acceptance of the return by Tiarè di Baiardini Clorinda. After 14 days Tiarè di Baiardini Clorinda reserves the right not to accept the return.

Compliance checks of returned products

You will be contacted if your return cannot be accepted because it does not comply with the conditions listed above, and you can choose to have the purchased products returned at your expense. In the event that you refuse this shipment, Tiarè di Baiardini Clorinda reserves the right to retain the products and the amount corresponding to the purchase price of the products.

All products must be returned new and unused, in perfect condition, with all protective materials and with the identification tags and stickers attached to the products (if any), as well as their packaging, accessories and documentation. If the product shows signs of use or if it has been used or altered from its original condition in any way, Tiarè di Baiardini Clorinda reserves the right not to accept the return or, alternatively, to reduce the amount of the refund or exchange accordingly.

For example, Tiarè di Baiardini Clorinda may reduce the refund in the following circumstances:
• the products have been used, worn, damaged or washed;
• the identification tag is no longer attached to the products with the disposable seal or has not been returned. Please note that the identification tag is an integral part of each product; and/or
• the original packaging which is an integral part of the product (e.g. the protective bag) has not been returned;

You will be contacted if Tiarè di Baiardini Clorinda decides to reduce the refund for this reason. In this case, you can choose (as an alternative to the reduction of the refund) to have the purchased products returned at your expense. In this last case, if you refuse the shipment, Tiarè di Baiardini Clorinda will have the right to retain the products and the amount indicated for the reduction of the refund, due to the decrease in value of the returned products.

Tiarè di Baiardini Clorinda assumes no responsibility in the event of products returned by mistake or objects forgotten in packages or returned products.

Refund times and methods

After Tiarè di Baiardini Clorinda has received your return and checked that all the requirements have been met, you will receive an email confirming acceptance of the return and Tiarè di Baiardini Clorinda will proceed with the full refund, or, if a decrease in value of the returned products is found, you will receive an email informing you of the amount deducted as a reduction in the refund and Tiarè di Baiardini Clorinda will proceed with the refund of the amount due. Whatever payment method you used among those available, the refund is activated by Tiarè di Baiardini Clorinda as soon as possible, and in any case within fourteen (14) days from the date on which it became aware of the exercise of your right of withdrawal, once it has verified that the withdrawal has occurred in compliance with the conditions set out above.
The actual time for the refund or reimbursement of the sums paid by you for the purchase of the products depends on the payment methods used:

purchase via PayPal (if available): the refund will be made to your PayPal account and will be visible immediately. The actual refund to your credit card from your PayPal account depends on the institution that issued the card;
cash on delivery (if available): the refund will be made to the current account you indicated, so the refund time depends on the accuracy of the data you enter; normally the refund will be made within fourteen (14) days.
In the case of a gift, the refund of the sums will be made to the person who made the payment.
credit/debit card purchase: the refund time depends on the credit/debit card company, but usually occurs within two bank statements. Please note that the value date of the refund is the same as the debit, so you will not suffer any loss in terms of bank interest;
If you wish, as an alternative to the refund on your credit/debit card, PayPal account or the current account indicated by you, at the time of exercising the Right of Withdrawal, you can choose to receive the refund, through voucher. You can use your credit for purchases on tiareprofumeria.it according to the methods of the Conditions of Sale.
Purchase by cash on delivery: the refund will be made to a current account indicated by the customer at the time of the return.

Products affected by non-compliant defects

Without prejudice to the application of mandatory consumer protection regulations, you can return a product because it is defective or does not conform to what you ordered, by informing Tiarè di Baiardini Clorinda, within fourteen (14) days from the day you received the products purchased on tiareprofumeria.it, using the Return Form found in the Customer Service area; if the defect occurs after fourteen (14) days, contact Customer Service for more information.
For the methods of returning products, the methods described above apply.

Tiarè di Baiardini Clorinda will check the products that you have returned because they are defective or do not conform to what you ordered and will proceed with the full refund, including shipping costs and the costs you incurred to return the products to Tiarè di Baiardini Clorinda.

In the event that Tiarè di Baiardini Clorinda does not detect any defect or lack of conformity in the returned products, you will be informed that your return cannot be accepted and you will be able to choose whether to have the purchased products back. In the event that you refuse the shipment, Tiarè di Baiardini Clorinda will have the right to retain the products and the amount corresponding to the purchase price of the products, as well as reserves the right to request the costs incurred.

Conditions for exchanging products

In some cases, as specified below, you will have the possibility to exchange the products purchased with others of the same model, with different size and/or patterns. The exchange of products will be possible only if the products in the size and/or pattern are available at the Tiarè di Baiardini Clorinda warehouses.

The request for change will only take place within the following limits:

only those products purchased for which this possibility is expressly provided for in the Return Form may be exchanged; you may request the exchange of one or more products purchased only with products of the same model, with a different size and/or pattern.
you may request the exchange of one or more products purchased within and no later than fourteen (14) days from the date of their delivery, by completing the Return Form, to be sent electronically to Tiarè di Baiardini Clorinda within the aforementioned deadline. The products to be exchanged must be delivered to the courier within fourteen (14) days from when you communicated to Tiarè di Baiardini Clorinda your decision to exchange the products;
you will be able to make only one exchange request for each product purchased;
the products for which you request an exchange must be returned to Tiarè di Baiardini Clorinda in their original packaging, unused, unworn, unwashed or damaged, and the identification tag must still be attached with the disposable seal;
Products to be exchanged that are part of a single order must be sent to Tiarè di Baiardini Clorinda in a single shipment. Tiarè di Baiardini Clorinda, in fact, reserves the right to not accept products from the same order, sent for exchange at different times.

If all the above conditions are correctly respected, once the Return Form containing your exchange request has been filled out and sent, Tiarè di Baiardini Clorinda will take charge of the same replacement request by sending you a confirmation email to this end.

After Tiarè di Baiardini Clorinda has received the products you intend to exchange and checked that all the requirements set out above have been met, Tiarè di Baiardini Clorinda will verify the actual availability of the products in the size and/or pattern you have selected in its warehouses.

In the event that the product or products selected for exchange are not available in its warehouses, Tiarè di Baiardini Clorinda will not be able to accept your exchange request and will therefore proceed to refund you the price of the product or products originally purchased and not replaceable, in accordance with the provisions of the Consumer Code and according to the methods set out above.
