If you have exercised your right of withdrawal, we will send you an email to confirm cancellation from the Services. Tiarè di Baiardini Clorinda reserves the right to cancel your registration to the Services in the event of violation of the provisions contained in these Conditions, or in the event that complete, truthful and correct personal data has not been provided, without prejudice to the right to compensation for damage suffered. . GENERAL CONDITIONS OF SALE

The sale of products on our website (“tiareprofumeria.it”) is governed by these General Conditions of Sale.

The products purchased on tiareprofumeria.it are sold directly by Tiarè di Baiardini Clorinda, an individual company, with registered office in Italy, Via Lorenzo Fava , 26 – 84014 Nocera Inferiore SA (Italy) , registered. Company Reg., Tax Code and VAT no. 05508020657.

Commercial policy

1. The Seller carries out its e-commerce activity on tiarethebeauty.it exclusively towards its end users who have reached the age of majority and are "consumers".
2. When we talk about "consumer" we refer to any natural person who acts on tiareprofumeria.it for purposes not related to their commercial, entrepreneurial or professional activity, if any. If you are not a "consumer", we invite you to refrain from concluding commercial transactions on tiareprofumeria.it.
3. In consideration of its commercial policy, the Seller reserves the right not to accept purchase order proposals from parties other than the "consumer" or in any case purchase order proposals that do not comply with its commercial policy, such as, for example, order proposals for which there is a report, or suspicion, of fraudulent or illegal activity. In such cases, the Seller will communicate to the user the non-acceptance of the order proposal. All order proposals sent to the Seller and returns made by users must also correspond to normal consumption needs. The Seller therefore monitors the number of order proposals transmitted and returns made.
4. These General Conditions of Sale exclusively regulate the sending of purchase order proposals for products available on tiareprofumeria.it by the user and the acceptance of the same by the Seller.
5. However, the General Conditions of Sale do not regulate the supply of services or the sale of products by parties other than the Seller who appear on tiareprofumeria.it via links, banners or other hyperlinks.
6. The prices and sales methods that take place on the tiareprofumeria.it website may be different from those that take place in the physical stores of Tiarè di Baiardini Clorinda.

Information aimed at the conclusion of the contract with the Seller pursuant to Legislative Decree 9 April 2003, n. 70

1. To conclude the purchase contract for one or more products on tiareprofumeria.it, you will have to send a purchase order proposal to the Seller electronically by filling out the form available on tiarethebeauty.it and following the relevant instructions.
2. Before transmitting the order proposal, we remind you to carefully read the General Conditions of Sale and the information on the right of withdrawal, to print a copy using the print command and to memorize or reproduce a copy for your personal use . In compliance with article 51, paragraph 7, of Legislative Decree 6 September 2005, n. 206 (the “Consumer Code”), before transmitting the order proposal, we will provide you with a summary of the commercial and contractual conditions that will apply to your product purchase order proposal and a summary of the information on the essential characteristics of each product ordered with the relative price (including all applicable taxes or duties), the means of payment that you can use to purchase each product, the delivery methods of the purchased products, the shipping and delivery costs; as well as the references, geographical address and contact methods of the Seller and the date by which the Seller, once it has accepted your order proposal, undertakes to deliver the goods. The Seller will also provide you with a summary of the conditions and methods for exercising your right of withdrawal. If applicable, you will be informed that, in the event of withdrawal, you will have to bear the cost of returning the products. 3. 4. The transmission of the order proposal to the Seller constitutes a binding purchase proposal for the user. Before proceeding with the transmission of the order proposal, you will therefore be asked to identify and correct any data entry errors.
5. Once your order proposal has been sent, we will send you an automatic email to confirm receipt of your order proposal. Receipt of the aforementioned email does not constitute acceptance of your order proposal.
6. The contract is concluded when your order proposal is accepted by the Seller. The Seller will send you a second e-mail to confirm acceptance of your order proposal and the shipment of the products. This email will also contain a copy of the General Conditions of Sale and the summary document on the Right of Withdrawal.
7. The order proposal sent to the Seller will be archived in our database for the period of time necessary to process the order proposals accepted by the Seller and in any case within the terms of the law. You will be able to access your order proposal form by consulting the My Order section.
8. The language available to conclude the contract with the Seller is Italian.
9. The Seller may not accept your purchase order proposals that do not give sufficient guarantees of solvency or that are incomplete or incorrect or in the event of unavailability of the products.
10. In these cases, the Seller will inform you by email that the contract is not concluded and that the Seller has not accepted your purchase order proposal, specifying the reasons. Guarantees and product price indications

1. Tiarè di Baiardini Clorinda sells exclusively luxury and top quality branded products. These products are purchased directly from Tiarè di Baiardini Clorinda from official manufacturers and retailers.
2. Tiarè di Baiardini Clorinda does not sell used, irregular or lower quality products than the corresponding standards offered on the market.
3. The essential characteristics of the products are presented on tiareprofumeria.it within each product description. However, the images and colors of the products presented on tiareprofumeria.it may not correspond to the real ones due to the Internet browser and monitor used.
4. Product prices may be subject to updates. Check the final sales price before submitting the relevant order proposal. In the event that a recognizable error is found in the indication - by the Seller - of the price of a product or in the calculation of the amount requested for payment, the Seller will not accept the order proposal and will contact the user in order to to offer the opportunity to transmit the purchase order proposal for the product(s) at the correct price.
5. Purchase requests from countries not included among those displayed on the splash page cannot be accepted by the Seller.
6. All products sold by Tiarè di Baiardini Clorinda are equipped with a guarantee seal.
7. All products sold on tiareprofumeria.it are covered by a twenty-four (24) month legal guarantee for defects of conformity, in accordance with applicable law. The lack of conformity of the product must be communicated to the Seller within two (2) months of its discovery. The lack of conformity of the products sold by Tiarè di Baiardini Clorinda can be communicated to Tiarè di Baiardini Clorinda by contacting us via email. In case of lack of conformity you have the right to request repair or replacement of the product. Payments

1. To pay the price of the products and the related shipping and delivery costs you can follow one of the methods indicated in the order proposal form. In no case will you be charged costs higher than those actually incurred by the Seller, in relation to the payment instrument chosen by you.

In case of payment by credit card, the financial information (for example, the credit/debit card number or its expiration date) will be forwarded, via encrypted protocol, to Banca Intesa Sanpaolo or to other banks, which provide the related remote electronic payment services, without third parties being able to have access to them in any way. Furthermore, this information will never be used by the Seller except to complete the procedures relating to your purchase and to issue the relevant refunds in the event of any product returns, following exercise of your right of withdrawal, or if it becomes necessary. prevent or report to the police the commission of fraud on tiarethebeauty.it. Voucher

1. Vouchers are personalized codes, which allow you to take advantage of a discount on purchases made on Tiareprofumeria.it relating exclusively to products sold by Tiarè di Baiardini Clorinda.
2. The box for entering the code appears on the first page of the purchase process: once you have inserted the items in the Shopping Bag, enter your code in the box and click on Recalculate. At this point the discount will automatically be applied to all products, except those to which vouchers cannot be applied. Therefore the other items included in the Shopping Bag will not be subject to any discount. The voucher can only be used once and cannot be converted into cash in any way. It will not be possible to use multiple vouchers in the same order proposal.
3. If you want to return an item to which you have applied the voucher, you will have to follow the return procedure indicated in the information on the right of withdrawal. Once your return has been accepted, you can request the reactivation of the code with its original value. The difference in expenses you incurred for the purchase of the item will be credited back to you according to the methods and terms established for the normal reimbursement procedure.

Shipping and delivery of products

Refund times and methods

1. Whatever payment method you use, the refund due, in full or in part, is activated by the Seller, as quickly as possible and in any case within fourteen (14) days from the date on which the Seller became aware of the exercise of your right of withdrawal subject to verification of the correct execution of your right of withdrawal and verification of the returned products.
2. The Seller will refund you using the same payment method you used for the purchase of the returned products, unless you have expressly agreed with the Seller to use a different payment method and provided that you do not incur any costs. further as a consequence of the reimbursement. If there is no correspondence between the recipient of the products indicated in the order proposal and the person who made the payment of the sums due for their purchase, the reimbursement of the sums, in the event of exercise of the right of withdrawal, will be carried out by the Seller, in in any case, towards the person who made the payment.
3. We remind you that the value date of the credit is the same as the debit; consequently you will not suffer any loss in terms of bank interest.
4. If purchasing through Klarna, a 3% fee will be deducted at the time of refund.

applicable law and dispute resolution

1. Without prejudice to the application of mandatory European consumer protection regulations, the General Conditions of Sale are governed by Italian law and in particular by the Consumer Code and Legislative Decree 9 April 2003, n. 70 (“Implementation of Directive 2000/31/EC relating to certain legal aspects of information society services in the internal market, with particular reference to electronic commerce”).
2. In the event of disputes between Tiarè di Baiardini Clorinda and each end user, arising from the General Conditions of Sale, we inform you that the European Commission provides a platform for the alternative extra-judicial resolution of disputes, accessible on the site http://ec.europa.eu/odr .
3. For all disputes relating to purchases and/or these General Conditions of Sale, the Court of the place of domicile or residence of the consumer will be competent according to the applicable law or, at the choice of the consumer himself, the Court of Nocera Inferiore.

RIGHT OF WITHDRAWAL

Right of withdrawal from the contract signed with Tiarè di Baiardini Clorinda

In compliance with the art. 52 of Legislative Decree 6 September 2005 n. 206 (the “Consumer Code”), you have the right to withdraw from the contract signed with Tiarè di Baiardini Clorinda without any penalty and without having to provide any reason, within 14 days from the day on which you received the products purchased on tiareprofumeria.it.
In compliance with the art. 54 of the Consumer Code, you can exercise the right of withdrawal using, at your choice, one of the following methods:

1. Online transmission to Tiarè di Baiardini Clorinda of the Return Form found in the Customer Service area, completed in full; in this case, Tiarè di Baiardini Clorinda will send you confirmation by e-mail of receipt of the withdrawal declaration;
2. I send by post to Tiarè di Baiardini Clorinda the return form found in the Customer Service area, compliant with the standard form pursuant to art. 49, paragraph 4, of the Consumer Code, to be completed in full;
3. Sending by post to Tiarè di Baiardini Clorinda another explicit declaration of your decision to withdraw from the contract.
   In cases 2) and 3) your declaration must be sent to the attention of Customer Service at the registered office of Tiarè di Baiardini Clorinda, located in Via Lorenzo Fava , 26 – 84014 Nocera Inferiore (Italy) . It is understood that, in such cases, the burden of proving the correct and timely exercise of the right of withdrawal will be yours.
   In compliance with the art. 57 of the Consumer Code, once the withdrawal from the contract has been exercised, the products to be returned must be delivered to the courier within fourteen (14) days from the date on which you communicated your decision to withdraw from the contract to Tiarè di Baiardini Clorinda.
   In compliance with the art. 59 of the Consumer Code, the right of withdrawal is excluded in the event that you have purchased tailor-made or personalized products or sealed goods that are not suitable for return for hygienic reasons or related to health protection and have been opened after delivery.

Conditions for exercising the right of withdrawal in accordance with the art. 52 of the Consumer Code

The right of withdrawal is considered exercised correctly if the following conditions are fully respected:

1. The right of withdrawal must be regularly exercised within fourteen (14) days of receipt of the products following one of the methods indicated above;
2. The products must not have been used, worn, washed and, in any case, must comply with the requirements indicated in the art. 3, below, on the conformity checks of returned products;
3. The identification tag must still be attached to the products with the disposable seal which constitutes an integral part of the goods (see article 5 below in this regard);
4. The products must be returned in their original packaging (if you want to return a kit, you must return all the items that make it up);
5. The returned products must be delivered to the shipping company within fourteen (14) days from when you communicated to Tiarè di Baiardini Clorinda your decision to withdraw from the contract;
6. The products must not be damaged.
   If you have respected all the required conditions, Tiarè di Baiardini Clorinda, in compliance with the art. 56 of the Consumer Code, will refund you in full the price of the products purchased, with only the return costs being your responsibility, i.e. those for returning the purchased products to Tiarè di Baiardini Clorinda, unless Tiarè di Baiardini Clorinda has expressly exempted from these costs at the time of purchase and on the further condition that you use the forwarding agent and the shipping methods suggested by Tiarè di Baiardini Clorinda in the following paragraph.

Method of returning products to Tiarè di Baiardini Clorinda

You will be free to return the products with the courier you deem most appropriate. The return costs will be completely borne by the customer as well as the responsibility in case of loss or damage to the products during transport. The returned products must be delivered to our office no later than 14 days after acceptance of the return by Tiarè di Baiardini Clorinda. Beyond 14 days Tiarè di Baiardini Clorinda reserves the right not to accept the return.

Conformity checks of returned products

You will be contacted if your return cannot be accepted because it does not comply with the conditions listed above, and you can choose to have the products purchased back at your expense. If you refuse this shipment, Tiarè di Baiardini Clorinda reserves the right to withhold the products and the amount corresponding to the purchase price of the products.

All products must be returned new and unused, in perfect condition, with all protective materials and with identification tags and stickers attached to the products (if any), as well as their packaging, accessories and documentation. If the product shows signs of use or if it has been used or altered from its original condition in any way, Tiarè di Baiardini Clorinda reserves the right not to accept the return or, alternatively, to reduce the refund amount or of the exchange accordingly.

For example, Tiarè di Baiardini Clorinda will be able to make a reduction in the refund in the following circumstances:
• the products have been used, worn, damaged or washed;
• the identification tag is no longer attached to the products with the disposable seal or has not been returned. Please note that the identification tag is an integral part of each product; and/or
• the original packaging which is an integral part of the product (e.g. the protective bag) has not been returned;

You will be contacted if Tiarè di Baiardini Clorinda decides to reduce the refund for this reason. In this case, you can choose (as an alternative to deducting the refund) to have the products purchased back at your expense. In this last case, if you refuse the shipment, Tiarè di Baiardini Clorinda will have the right to retain the products and the amount indicated for the reduction of the refund, due to the decrease in value of the returned products.

Tiarè di Baiardini Clorinda assumes no responsibility in the event of products returned by mistake or objects forgotten in packages or returned products.

Refund times and methods

After Tiarè di Baiardini Clorinda has received your return and checked that all the requirements have been met, you will receive an email confirming acceptance of the return and Tiarè di Baiardini Clorinda will proceed with the full refund, or, if the existence of a decrease in value of the returned products, you will receive an email in which you will be notified of the amount deducted as a reduction of the refund and Tiarè di Baiardini Clorinda will proceed with the refund of the amount due. Whatever payment method you use among those available, the refund is activated by Tiarè di Baiardini Clorinda as soon as possible, and in any case within fourteen (14) days from the date on which it became aware of the exercise of your right of withdrawal, once it has been verified that the withdrawal has taken place in compliance with the conditions set out above.
The actual time for crediting or returning the sums paid by you for the purchase of the products depends on the payment methods used:

1. purchase via PayPal (if available): the refund will be made to your PayPal account and will be immediately visible. The actual refund to your credit card from your PayPal account depends on the institution that issued the card;
2. cash payment on delivery (if available): the refund is made to the current account indicated by you, so the reimbursement time depends on the correctness of the data you enter; normally the refund takes place within fourteen (14) days.
   In the case of a gift, the sums will be refunded to the person who made the payment.
3. purchase by credit/debit card: the refund time depends on the credit/debit card management company, but normally occurs within two bank statements. We remind you that the value date of the credit is the same as the debit, so you will not suffer any loss in terms of bank interest;
4. If you wish, as an alternative to the refund on your credit/debit card, on the PayPal account or on the current account indicated by you, when exercising the Right of Withdrawal, you can choose to receive the refund via voucher. You can use your credit for purchases on tiareprofumeria.it according to the Conditions of Sale.
5. Purchase by cash on delivery: the refund will be made to a current account indicated by the customer at the time of return.

Products affected by non-compliant defects

Without prejudice to the application of mandatory consumer protection regulations, you can return a product because it is affected by defects or does not conform to what was ordered, by informing Tiarè di Baiardini Clorinda, within fourteen (14) days from the day on which you received the products purchased on tiareprofumeria.it, using the Return Form found in the Customer Service area; if the defect appears after fourteen (14) days, contact Customer Service for more information.
For the methods of returning the products, the methods previously described apply.

Tiarè di Baiardini Clorinda will check the products you have returned because they are affected by defects or do not conform to what was ordered and will proceed with a full refund, including shipping costs and the expenses you incurred to return the products to Tiarè di Baiardini Clorinda.

In the event that Tiarè di Baiardini Clorinda does not detect any defects or lack of conformity in the returned products, you will be informed that your return cannot be accepted and you will be able to choose whether to receive the purchased products back. If you refuse the shipment, Tiarè di Baiardini Clorinda will have the right to retain the products and the amount corresponding to the purchase price of the products, as well as reserves the right to request the costs incurred.

Conditions for exchanging products

In some cases, as specified below, you will have the possibility to exchange the products purchased with others of the same model, with different sizes and/or patterns. The exchange of products will be possible only if the products in the size and/or pattern are available at the Tiarè di Baiardini Clorinda warehouses.

The exchange request will only take place within the following limits:

1. Only those products purchased may be subject to exchange, for which this possibility will be expressly provided for in the Return Form. You can request the exchange of one or more products purchased only with products of the same model, with a different size and/or pattern.
2. you can request the exchange of one or more products purchased no later than fourteen (14) days from the date of their delivery, by completing the Return Form, to be sent electronically to Tiarè di Baiardini Clorinda within the aforementioned deadline. The products to be exchanged must be delivered to the courier within fourteen (14) days from when you communicated your decision to exchange the products to Tiarè di Baiardini Clorinda;
3. you can only make one exchange request for each product purchased;
4. the products for which you request an exchange must be returned to Tiarè di Baiardini Clorinda in their original packaging, unused, worn, washed or damaged, and the identification tag must still be attached with the disposable seal;
5. the products to be exchanged which are part of a single order must be sent to Tiarè di Baiardini Clorinda in a single shipment. Tiarè di Baiardini Clorinda, in fact, reserves the right not to accept products from the same order, sent for exchange at different times.

If all the conditions mentioned above are correctly respected, once the Return Form containing your exchange request has been completed and sent, Tiarè di Baiardini Clorinda will take charge of the same replacement request by sending you a confirmation email to this end.
